Terms of Service

1. Parties & Acceptance
These Terms of Service ("Terms") govern the relationship between devMYK ("we", "us", "our") and you ("Client") as a recipient of our services. By engaging us or accessing our services, you agree to be bound by these Terms.
2. Services
devMYK provides digital growth services to local small businesses, including:
- Google Business Profile (GBP) optimization
- Missed-call text-back automation
- Review generation automation
- High-conversion website development
- Local SEO and reputation management
- Google & Meta paid advertising (Tier 3 only)
The exact services are detailed in your service agreement or order confirmation.
3. Payment
- Services are billed monthly in advance in Canadian dollars (CAD).
- Your first month covers initial setup — no additional onboarding fees are charged.
- Invoices unpaid after 15 days may result in service suspension.
- All prices are exclusive of applicable taxes unless otherwise stated.
4. Cancellation
You may cancel your subscription at any time with 30 days written notice to Show email. No penalties or cancellation fees apply. Services continue until the end of the current paid billing period.
5. Performance Guarantee
If your inbound call volume does not increase within the first 30 days of go-live, we will continue working at no additional charge until measurable results are achieved — for up to 90 additional days. This guarantee applies provided the Client has met their obligations as defined in Section 6.
Note: specific outcomes such as exact ranking positions, precise call volumes, or revenue figures cannot be guaranteed due to external factors outside our control, including local competition and Google algorithm changes.
6. Client Responsibilities
To enable us to deliver results, the Client agrees to:
- Provide accurate and up-to-date business information;
- Grant necessary access to Google Business Profile, domain, and other relevant platforms;
- Respond to information requests within 5 business days;
- Maintain an active, non-suspended Google Business account.
Delays caused by Client inaction do not extend the billing period and may void the performance guarantee.
7. Intellectual Property
Upon receipt of full payment, the Client owns the website and creative assets we produce for them. devMYK retains the right to showcase the completed work in our portfolio unless the Client requests otherwise in writing within 30 days of delivery.
8. Access & Credentials at Termination
Within 5 business days of termination, devMYK will transfer or return all Client-owned credentials and assets (Google Business Profile, domain, ad accounts, etc.). devMYK will revoke its own access within the same timeframe.
9. Limitation of Liability
devMYK's liability is limited to fees paid in the 30 days prior to any claim. devMYK is not liable for indirect, incidental, or consequential damages, including lost revenue or data loss.
10. Governing Law
These Terms are governed by the laws of the Province of Quebec, Canada. Any disputes shall be resolved in the courts of Quebec.
11. Changes to These Terms
We may modify these Terms by notifying you by email with 14 days notice. Continued use of our services after that period constitutes acceptance of the updated Terms.
